Seller Terms
The Seller Terms describe and specify the rights and obligations between you and the Buyer. When you agree to these Seller terms, it indicates that you have previously agreed to the aforementioned rights and obligations and that you will be bound by these terms.
If there is a conflict between the English version of the terms and other language versions, the English version shall prevail. Any legal terms and concepts used in the terms will be interpreted in accordance with the law of Hong Kong.
1. Register as a Seller
- Create a Seller Account.When registering as a Seller, you are obligated to truthfully provide information listed on the signup form on WhatsBid’s platform.
- Further identification. Our payment service provider may also require additional identification information in order to sell or receive payments.
- On the WhatsBid Platform, Buyers can purchase Items by bidding, paying a reserve price or a retail price. Reserve price refers to the minimum price at which the Seller will sell a Lot for.
- All items available for purchase are called ("Items"). There are two types of Items: Items sold through bidding and paying a reserve price are called ("Lots"). Items purchased at retail prices are called ("Products").
- The Seller is fully responsible for the Items they are selling.The Seller should ensure the compliance, quality, safety, legality, origin and authenticity of their Items, as well as the accuracy, accuracy and completeness of the Item description and photos.
- By registering as a Seller, you accept this Seller Terms, General Terms and Conditions, and other applicable terms listed on WhatsBid’s Platform that applies to you.
- You are required to provide up-to-date information about your bank account to receive the settlement fund.
2. Offering Lots for Auction
- We require a correct, clear and comprehensive description of your Items for auction.
- Correct, complete and accurate description
- Condition and category of the Item for auction
- Information on the original location of the Item for auction
- Clear photos of the Item for auction’s real, current condition (including any defects), features and other details
- All information and documents available and owned regarding the origin and authenticity of the Item for auction and, if applicable, a certificate of authenticity
- Available data and files regarding the origin and authenticity of the
- The Reserve Price
- Any other conditions related to bidding for this Item
- You are responsible for providing a correct description of the Item for auction. You guarantee that the final description you use accurately describes the Item for auction.
- You are responsible for ensuring that the Item for auction matches its description. You guarantee that the Items you offer for auction comply with the description, photos and any other materials uploaded and meet the reasonable expectations of the Buyer for such Items for auction.
- You guarantee your right to sell the Item for auction.
- You are responsible for complying with import and export control laws and regulations and ensure no intellectual property rights are infringed.
- Before putting your Items up for auction, you must be cautious in uploading and publishing the relevant materials and pricing information. Once this information has been made public, it cannot be retracted.
3. Items for Sale or Auction
- Once your Item is posted on the WhatsBid platform, other users can bid on it and purchase it. By selling on our platform, you agree to the following rules:
- You agree to provide WhatsBid with a competitive price for your lot, which shall be in accordance to the following percentage: i) Lots sold via bidding: 20% below market price or your listing price (whichever is higher); or ii) Products / Lots sold via reserve price: 10% below market price or your listing price (whichever is higher)
- At the end of the online auction, you will automatically establish a sales relationship with the highest bidder (Buyer) of the lot that exceeds its reserve price.
- We do not allow bidding up. You may not bid on your own or on an Item of someone related to you. You may also not let someone related to you bid on your or instruct others to bid on your lot.
- The regular commission rate for Lots will be charged to the Seller if the Buyer refuse the purchases of the bidding item due to defects.
- WhatsBid will provide the Seller with a three-day advance notice of an upcoming auction. The Seller agrees to reserve the Lot from three days before the auction until three days after the auction concludes. In the event that the product becomes unavailable at any time during this period, the Seller shall follow the withdrawal policy.
- The Lot you provide on our online bidding platform shall be exclusively offered here. When offering a Lot on our online bidding platform, you will not offer them through other sales channels. If the Item is listed on our platform, you shall remove them from other websites (including online platforms) and your own or someone else's (network) store. This restriction is necessary because selling a Lot both in our online auction and other sales channels would mean that you will be unable to fulfil your delivery obligations under the sales contract. Whatsbid and the Buyer need to be able to trust that you will always fulfill your obligations under the sales.
4. Delivery or Pickup
- The Seller is responsible for the delivery of the sold Item. The terms for delivery are listed as follows:
- For Items to be delivered in Hong Kong, the Seller shall co-orporate with WhatsBid to ensure smooth delivery of the Item. For auction items, it may be necessary for you to arrange a personal pickup with the Buyer at your location. For all Products that are to be delivered, they must be delivered or transported within three working days from the day of payment from the Buyer unless alternative arrangements have been made and is approved from all parties to the transaction.
- The Seller is responsible for shipment charges unless alternative arrangements have been made.
- Items to be delivered internationally shall be arranged by the Seller in accordance with the applicable laws and regulations of the destination country. The Seller shall bear the costs and risks of the international delivery, including but not limited to customs duties, taxes, fees, insurance, and transportation charges. The Seller shall provide WhatsBid and the Buyer with the tracking information and proof of delivery of the Item. The Item must be delivered or transported within seven working days from the day of payment from the Buyer unless alternative arrangements have been made and is approved from all parties to the transaction.
- If there are any transport issues, you must negotiate directly with the Buyer. Transportation will be the sole responsibility of the Seller.
- WhatsBid shall not be liable for any damages incurred during the delivery of any Items.
- The return policy and cost for any Items shall be stated in the product description.
5. Settlement Policy
- WhatsBid will collect payment from the Buyer on behalf of the Seller upon completion of the auction.
- WhatsBid will deduct its commission and any applicable fees or taxes from the Buyer’s payment before settling the balance to the Seller.
- The applicable commission due to WhatsBid for any lot sold using WhatsBid services shall be the following:
- Lots sold via bidding: 10%
- Lots sold via reserve price: 10%
- Products: To be negotiated directly with WhatsBid
- Whenever applicable, we also charge Buyer a commission fee for our services. When you accept these Seller terms, it means you explicitly agree that we may charge fees to both parties in a transaction.
- WhatsBid will transfer payment to the Seller according to the following schedule:
- For sales that end between the 1st and the 24th day of each month, the payment will be transferred to the Seller on or before the 5th day of the following month or next working day if it falls onto non-banking day.
- For sales that end between the 25th and the last day of each month, the payment will be transferred to the Seller on or before the 20th day of the following month or next working day if it falls onto non-banking day.
- The Seller shall receive the payment from WhatsBid by the method specified in the contract between them.
6. Withdrawal Policy
- The Seller has the right to withdraw their Item from the online auction platform at any time, subjected to the following penalties:
- pre-bidding period: 10% of the reserve price
- during bidding: 100% reserve price or the highest bid received, whichever is higher
- post-bidding: 100% reserve price or the highest bid received, whichever is higher
- The Seller acknowledges that withdrawing their Item from the online auction platform may cause damage or loss to WhatsBid, the Buyer, or any other third party who may have an interest in the transaction. The Seller agrees to indemnify and hold harmless WhatsBid, the Buyer, and any other third party from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising out of or relating to the Seller’s withdrawal of their Item. The Seller also agrees to cooperate WhatsBid in resolving any disputes or issues arising from their withdrawal.
- The penalty shall be paid within 7 working days upon withdrawal via bank transfers to WhatsBid.
7. Consequences of non-compliance with our Terms of Use
- If you breach our terms and conditions or engage in unlawful activities, we may terminate your account permanently within 30 working days.
8. Liabilities and Warranties
- The Seller agrees to indemnify and hold harmless WhatsBid, the Buyer and any third parties from any loss, damage, liability, cost or expense (including legal fees) arising out of or in connection with any breach of the above representations and warranties or any negligence or wilful misconduct of the Seller. The Seller agrees to cooperate with WhatsBid in resolving any disputes or issues arising from or related to the sale of the Item.
