Buyer Terms
The Buyer terms describe and specify the rights and obligations between you and the Seller. When you agree to these Buyer terms, it indicates that you have previously agreed to the aforementioned rights and obligations and that you will be bound by these terms.
If there is a conflict between the English version of the terms and other language versions, the English version shall prevail. Any legal terms and concepts used in the terms will be interpreted in accordance with the law of Hong Kong.
1. Registering as a Buyer
- Create a Buyer account. When registering as a Buyer, you need to provide your full legal name, phone number, email address . You are obligated to truthfully provide identification information according to our terms.
- You are responsible for keeping your account information accurate.
- By registering as a Buyer, you accept this Buyer Terms, General Terms and Conditions, and other applicable terms listed on WhatsBid’s Platform that applies to you.
2. Purchasing a Lot /Product
- On the WhatsBid Platform, Buyers can purchase Items by bidding, paying a reserve price or a retail price. Reserve price refers to the minimum price at which the Seller will sell a Lot for.
- All items available for purchase are called ("Items"). There are two types of Items: Items sold through bidding and paying a reserve price are called ("Lots"). Items purchased at retail prices are called ("Products").
- Purchase via Bidding or Paying Reserve Price
- If your bid reaches the reserve price and is the highest at the end of the auction, you will automatically form a sales relationship with the Seller. If the reserve price is not reached at the end of the auction, the Lot will be withdrawn.
- We will charge you a non-refundable Buyer fee (“commission fee”) is 5% (five percent) of the Purchase Price for successful bidding using the platform service. We reserve the right to charge up to 15% for special items. We will add this amount to the purchase price, and we also provide services to the Seller and charge fees for it. When you accept these Buyer terms and conditions, you explicitly agree that we will charge fees to both parties for the same transaction.
- Purchase via Paying Retail Price
- WhatsBid will not charge you any commission for purchasing Products.
3. Paying for the Lot/Product
- If you are the highest bidder at the end of the auction and your bid exceeds the reserve price, you will pay for the Lot according to our instructions and the following payment terms.
- For antique purchases via bidding or direct buying by paying the reserve price (or Purchase Price?), you are not required to pay in full the final bidding price or reserve price and the commission until physical inspection of the Lot is complete. However, you are required to pay a HK$1,000 deposit (the “Deposit”) within one business day of winning the auction or checking out via WhatsBid’s platformh. The deposit is refundable if the purchases is unsuccessful and deductible if the sale is successful.
- For watches purchases via bidding or direct buying by paying the reserve price, the Buyer will be required to pay the final bidding price plus commission fee within one business day after the online auction closes via WhatsBid’s platform.
- You guarantee that your purchase is legal. You guarantee that you will not purchase the Lot as part of a fraudulent or illegal transaction, and you and/or third parties will not directly or indirectly participate or be involved in any activities that may in any form or manner imply money laundering.
- All Products purchased other than bidding are to be paid in full upon checkout.
4. Delivery or pickup of a Lot/Product
- Once you have made payment according to section 3, we will notify the Seller to ship the Lot or arrange for personal pickup with you. For the majority of the Lot we host, the Seller will ship the Product to the address associated with your account or it may be necessary for you to pick it up directly from the Seller's location. The Buyer is obliged to arrange collection or inspection of purchased Lots no later than 30 calendar days after the date of sale, or if applicable, within the time stipulated in the relevant sale information available on our website.
- Please make sure your address is correct. The Seller will ship your Lot or Product to the address in your account. The address must be a physical location.
- Please confirm receipt of your Lot within three working days after delivery. If we do not receive the relevant confirmation within three working days, the payment will be withheld until both parties have successfully and confirmed delivery.
- All packing and handling are at the Buyer's risk. We will not be liable for any acts or omissions of third-party packers or shippers.
- If there are any transport issues, you must negotiate directly with the Seller. Transportation will be the sole responsibility of the Seller.
- Failure to deliver will result in the transaction being cancelled. The Deposit will be returned to the Buyer in the same method it was paid.
5. Failure to fulfil your obligations towards WhatsBid
- If you fail to fulfil your obligations towards WhatsBid under the Terms of Use, we may decide to cancel the transaction of the relevant Lot. This means you will still owe us Auction Fee in addition to any other damages. You will also be liable for the amount of Seller’s Commission that we missed out on as a result of the cancellation.
- Consequences of your failure to comply with our Terms of Use
If you
- violate our Terms of Use
- your conduct is questionable, or
- are necessary to protect our Platform, other users, or in the general (public) interest,
- prevent fraud or other illegal activities
- We may take one or more of the following measures:
- If you paid for a Lot with your credit card and, even though the Seller was not in default, you filed a successful chargeback, we reserve or rights to (i) block your Account, (ii) set-off any claims we have towards you, (iii) block any future payments (including refunds) to you, and (iv) initiate legal proceedings against you.
- If our agreement is terminated or your access to your account is suspended, you still have certain obligations to the Seller according to the sales contract.
